End User License Agreement

Note: This summary and the key points that follow are provided for convenience. The legally binding terms appear below and will take precedence if there is any inconsistency.

• You receive a license to use our games and services; you do not own the software.
• Virtual Items (ranks, cosmetics, currency) are licensed to you and have no real-world value.
• You can create and share content, but don't distribute our original game files.
• Don't cheat, exploit, or violate laws. We can suspend or terminate access for violations.
• We own our games, services, and trademarks. You own your original creations but grant us rights to use them.
• By agreeing to the EULA, you limit your rights and remedies, and damages may be capped.
• Disputes are governed by English and Welsh law.

The following sections contain the legally binding terms of this EULA.

1.1 This EULA governs your access to and use of: (a) all game servers and services operated by KORDU LTD; (b) our websites including kordu.gg, kordu.co.uk, kordu.net, kordu.uk, justified.co, and darkrp.uk; (c) all related content, updates, patches, and modifications we provide (collectively, the "Services").

1.2 Your access to the Services is also governed by our Terms of Service, Privacy Policy, and Cookie Policy (collectively, the "Policies"), which are incorporated by reference.

1.3 By downloading, accessing, or using the Services, you agree to be bound by this EULA. If you do not agree, do not use the Services. If you are under 18 (or the age of majority in your jurisdiction), your parent or guardian must agree to this EULA on your behalf.

1.4 This EULA, together with the Policies, constitutes the entire agreement between you and us regarding the Services. In the event of any conflict between this EULA and the Terms of Service, this EULA shall prevail regarding your use of the Services.

2.1 License Grant. Subject to this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services on devices you own or control for personal, non-commercial use.

2.2 Retained Rights. The Services are licensed, not sold. This EULA does not grant you any title or ownership in the Services, game software, or any content.

2.3 Online Features. Online features require an authenticated account (via Steam or Discord) and are subject to our Policies.

4.1 User Content. You may create, use, and share content including screenshots, videos, streams, builds, and other creative works related to our Services ("User Content").

4.2 License to Us. By creating or submitting User Content through our Services, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable, perpetual license to use, reproduce, modify, display, distribute, and create derivative works of your User Content for any purpose related to operating and promoting our Services.

4.3 Your Responsibility. You are responsible for your User Content. You represent that your content does not: (a) infringe third-party rights; (b) contain harmful, offensive, or illegal material; (c) contain malware or harmful code; or (d) harm KORDU's reputation or goodwill.

4.4 Distribution Rules. You may share User Content, but you may not distribute our game files, server software, proprietary code, or claim your content is officially endorsed by KORDU LTD.

You may NOT:

• Use cheats, hacks, exploits, bots, or automation tools
• Reverse engineer, decompile, or disassemble our software except as permitted by law
• Circumvent digital rights management, anti-cheat, or security measures
• Sell, trade, or transfer accounts, Virtual Items, or access for real currency
• Use unauthorized third-party services to obtain Virtual Items
• Exploit bugs or glitches to duplicate items, currency, or gain unfair advantages
• Rent, lease, sell, sublicense, or commercially exploit the Services
• Remove or alter proprietary notices, logos, or branding
• Impersonate KORDU LTD, staff members, or claim official affiliation
• Use the Services to violate applicable laws or third-party rights
• Harass, threaten, or abuse other users
• Attempt to access accounts, data, or systems without authorization

6.1 Integrity Measures. We implement anti-cheat and integrity measures to maintain fair play. These may include server-side detection, client-side telemetry, and third-party anti-cheat systems.

6.2 Data Collection. We may collect gameplay data, device information, network signals, and other information necessary to detect cheating, enforce rules, and operate the Services, as described in our Privacy Policy.

6.3 Enforcement. Violations detected by anti-cheat systems may result in immediate suspension or permanent ban without prior notice. Decisions are final and subject to our appeal process.

7.1 Ownership. KORDU LTD or its licensors own all rights, title, and interest in and to: (a) the Services, including all software, artwork, audio, content, characters, designs, and trademarks; and (b) all related intellectual property.

7.2 Trademarks. You may use "KORDU", "Justified", or related names descriptively to indicate compatibility (e.g., "content for KORDU servers"), but you may not use our logos, trade dress, or trademarks in a way that suggests endorsement or official origin without written permission.

7.3 Third-Party IP. You are solely responsible for ensuring your User Content respects third-party intellectual property rights and complies with applicable licenses.

8.1 Updates. We may provide updates, patches, content changes, or modifications to the Services at our discretion. Updates may be automatic and may modify or remove features, Virtual Items, or game mechanics.

8.2 Discontinuance. We may discontinue Services, game modes, servers, or features that are no longer viable, secure, or compliant. We will provide reasonable notice where required by law.

8.3 Compatibility. Updates may affect the operation of third-party content, mods, or addons. We are not responsible for compatibility issues with third-party products.

9.1 Effectiveness. This EULA is effective until terminated by either you or KORDU LTD.

9.2 Termination by Us. We may terminate or suspend this EULA and your access at any time, with or without cause, including if you violate this EULA, the Policies, or engage in conduct harmful to us, other users, or the Services. To the extent required by law, we will provide notice; otherwise, we may act without prior notice.

9.3 Termination by You. You may terminate this EULA by ceasing all use of the Services and, where applicable, requesting account deletion.

9.4 Effects of Termination. Upon termination:

• All licenses granted to you under this EULA immediately end
• You lose access to all Virtual Items, account content, and Services
• You are not entitled to refunds except where required by applicable consumer protection law
• Sections relating to ownership, disclaimers, limitation of liability, and governing law survive termination

10.1 DISCLAIMER. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL CODE.

10.2 Consumer Rights. Nothing in this EULA affects rights you cannot waive under applicable consumer protection laws. If you are in the UK or EU, you benefit from statutory rights regarding digital content conformity, and nothing in this EULA excludes or limits those rights.

10.3 Health & Safety. Gameplay may cause photosensitivity, motion sickness, or repetitive strain. Take regular breaks and consult a physician if needed.

11.1 Limitations. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KORDU LTD AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

11.2 Cap. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM THIS EULA OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (a) THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM; OR (b) ONE HUNDRED POUNDS STERLING (£100).

11.3 Exclusions. Nothing in this EULA limits or excludes our liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded by law.

11.4 Indemnity. You agree to indemnify and hold KORDU LTD harmless from any claims, damages, losses, or expenses arising from: (a) your breach of this EULA; (b) your User Content; or (c) your violation of laws or third-party rights.

12.1 Governing Law. This EULA shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

12.2 Jurisdiction. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising from this EULA, subject to your rights under mandatory local law to bring proceedings in your country of residence.

12.3 Mandatory Provisions. You may benefit from mandatory provisions of the law of the country in which you are habitually resident, and nothing in this EULA affects those rights.

13.1 Updates. We may update this EULA from time to time. We will provide reasonable notice of material changes (e.g., by email, website notice, or in-game notification) and specify the effective date.

13.2 Acceptance. To the extent permitted by law, your continued use of the Services after the effective date constitutes acceptance of the updated EULA. If you disagree, you must stop using the Services as set out in Section 9.3.

13.3 UK/EU Users. For users habitually resident in the UK or EU, we will only make changes for valid reasons, including to reflect changes in law, maintain security, address technical issues, prevent abuse, or improve the Services.

14.1 Severability. If any provision of this EULA is found unenforceable, the remaining provisions will remain in full force and effect.

14.2 Entire Agreement. This EULA, together with the Policies, constitutes the entire agreement between you and us regarding the Services and supersedes all prior agreements.

14.3 No Waiver. Our failure to enforce any term is not a waiver of our right to enforce it later.

14.4 Assignment. You may not assign this EULA without our prior written consent. We may assign this EULA in connection with a merger, acquisition, or sale of assets.

14.5 Force Majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.

14.6 Interpretation. The Key Points and section headers are for convenience and do not affect interpretation. "Including" means "including, without limitation."
